GENERAL CONDITIONS OF SALE AND USE

1. OBJECT

The website veganie.com.is an e-commerce site accessible via the Internet. It makes it possible to offer cosmetics, care and beauty products for sale to Internet users or users browsing the site.

Véganie is a registered trademark, Vegan Mania SARL with a capital of €100,000: SIREN no. 798 788 816. In accordance with the “Informatique et Libertés” law no. site has been declared to the CNIL (Commission Nationale de l'Informatique et des Libertés).

The purpose of these general conditions of sale is to inform the customer of the terms and conditions of the sale, the delivery of the products offered on the Véganie site accessible at the address veganie.com and to determine the reciprocal rights and obligations of the parties in the context of online sales. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

These conditions govern distance sales concluded by Vegan Mania SARL with non-professional buyers and are valid at the time the order is placed by the customer. These conditions of sale are subject to change at any time without notice. The new conditions of sale are binding on customers from the time they are put online and do not apply to transactions concluded previously.

2. INTELLECTUAL PROPERTY

Veganie is a registered trademark. The entire site, and each of its elements taken separately, constitute a protected work and fall under French legislation on copyright and intellectual property.

No commercial exploitation, reproduction, representation, use, modification, adaptation, translation, partial or complete of the elements of this site can be done without the prior authorization of Vegan Mania SARL.

3. PRODUCTS, PROMOTIONAL OFFERS, PRICES

Product offers and promotional offers, mentioned as such, are valid as long as they are visible on the site and available in stock.

The product offers offered on the site are limited to Metropolitan France (including Corsica), Monaco, Andorra, Luxembourg, Belgium and Switzerland, subject to available stocks.

The prices of the products indicated on the site are expressed in euros (€) VAT applicable to the inhabitants of the European Union. Prices are exclusive of handling and shipping costs. Shipping costs may be offered or payable depending on the case (for shipping costs, see article "7. Shipping costs - Delivery").

The products ordered on the site are at the price in effect when the order is registered. For customers based abroad, any customs fees are the responsibility of the customer.

Product refunds are made on the basis of the price actually paid by the customer. Example: An order of 40€ consisting of 4 products of 10€ is paid by the customer for 36€ after application of a promotion. If the customer wishes to be partially reimbursed for a product (under the conditions provided for by law) he will then be compensated (after receipt of the product by Vegan Mania) for an amount of €9 corresponding to the following calculation: Reimbursed product price = ( Price of the product to be refunded excluding promotion)*(1-((Total price of the order without reduction – Total price of the order with reduction)/(Total price of the order without reduction))).

In our example: Price of the product to be refunded = 10*(1-((40-36)/40)) = 9€

4 COMMANDS

To place an order, the customer must be of legal age.

It is up to the customer to select on the website the products he wishes to order by adding them to the basket (within the limit of a weight of 7 kilos per package, calculated automatically when placing the order). A summary of the items chosen is presented at the bottom of the basket.

Once their purchases are complete, the customer must enter the information necessary to register and track their order:

  • For an ALREADY REGISTERED customer: entry of their username and password.
  • For a FIRST ORDER: surname, first name, postal address, email address, telephone number, date of birth and choice of password.

All new customers receive an acknowledgment of receipt by e-mail summarizing their access codes. By clicking on the return link, the customer acknowledges that the information provided is accurate and can then continue with their order.

It is up to the customer to check the details of the items ordered and the total price of their order before confirming it so that they can modify it if necessary.

To definitively validate the order, the customer must click on "I confirm my order", after having read the General Conditions of Sale and having accepted them. Validation of the order therefore implies acceptance of these Specific Distance Selling Conditions.

The customer can then proceed to payment online, in accordance with the provisions of article “6. Payment".

Once the order is completed, the customer automatically receives a confirmation email.

It is possible at any time to follow the progress of an order by going to the Customer Area.

The information provided by customers will not, under any circumstances, be communicated to third parties and will remain strictly confidential (see the article "13. Confidentiality").

Vegan Mania reserves the right to cancel or suspend any order:

  • made by a customer with whom there is a dispute or who is the subject of a suspicion of fraud
  • not in accordance with these Terms and Conditions

Vegan Mania also reserves the right to prohibit access to the site in the event of a dispute, suspicion of fraud or malicious act.

In case of suspicion of credit card fraud, the shipment will be blocked.

The fraudulent use of its own banking information or that of a third party constitutes an offense punishable by a prison sentence of 5 years, as well as a fine of 382,000 euros. Any attempt is likely to be immediately recorded and reported to the Fraud Prevention services.

5. AVAILABILITY

Product and price offers are valid as long as they are visible on the site, within the limits of available stocks, unless otherwise specified.

6. SECURE PAYMENT - MEANS OF PAYMENT

8. CUSTOMER SERVICE

The customer can reach Customer Service by chat on the veganie.com website or call +33 (0)1 88 33 65 37. A follow-up will be provided: taken into account within 48 hours.

9. COMPLAINTS, DISPUTES

Only deliveries for the countries mentioned in section 3 are possible. Packages are shipped via Colissimo with tracking. Delivery is made to the delivery address indicated by the customer in the ordering process. In the event of the recipient's absence at the time of delivery, within the framework of the delivery provided by the carrier, the deliverer will leave a delivery notice in the recipient's mailbox, the latter must then come and collect it at the address specified on the transit advice note (post office).

Colissimo Suivi is a very reliable service. However, in case of late delivery, we ask you to notify us of the delay by sending us an email. We will then contact the Post Office to start an investigation.

A Poste investigation can last up to 21 days from the start date of the investigation. If during this period, the product is found, it will be re-routed immediately to your home (in the majority of cases). If, on the other hand, the product is not found at the end of the 21-day period of investigation, the Post Office considers the package as lost. Only then can we send you a replacement product, at our expense. If the product(s) ordered were no longer available at that time, we would reimburse you for the amount of the products concerned by the loss of the carrier. If the product(s) were still available, but had changed the selling price on the site, we would apply the new selling prices and give you a compensation discount.

Note COVID-19: If you had the choice between delivery with signature and without signature then Véganie disclaims all responsibility for any loss during the delivery phase. delivery.

A delivery slip is attached to your package. We advise you to keep it, it will serve as proof of delivery. You must check the conformity of the goods delivered at the time of delivery and before signing the carrier's delivery note.

You must indicate on this delivery note and in the form of handwritten reservations accompanied by your signature any anomaly concerning the delivery (damaged product, etc.). This verification is considered to have been carried out once you, or a person of your choice, have signed the delivery note. No complaint on the condition of the package(s) delivered will then be admissible.

In the event of reservations, you must also confirm these reservations by registered mail to the carrier no later than three working days following receipt of the item(s) and send a copy of this letter to the Customer Service of Vegan Mania SARL at 55 Boulevard de Sébastopol 75001 PARIS.

In the event of an incomplete address, change or error concerning the address, refusal of the package by the recipient or lack of information resulting in the impossibility of delivering the product to the recipient within the specified time , Vegan Mania cannot be held responsible for the final quality of the delivery. If this lack of information results in a second presentation to the recipient, Vegan Mania will be entitled to ask you for the costs corresponding to a second delivery.

In the absence of the recipient, Vegan Mania SARL cannot be held responsible for the final quality of the delivery.

We decline all responsibility for the extension of delivery times due to the carrier, in particular in the event of loss of products or strikes.

Any complaint concerning the delivery of the products must be made within 7 working days following the day of delivery.

In the event of a dispute, the customer will first contact Vegan Mania to obtain an amicable solution. Otherwise, the Commercial Court of the seller's registered office will have sole and exclusive jurisdiction (Paris).

NB: All parcels declared "Delivered" by the carrier and finally declared lost are only reimbursed by a credit note in the shop.

10. WITHDRAWAL

In accordance with Article 121-16 of the Consumer Code, the buyer has a withdrawal period of 14 days from receipt of his order.

The products must imperatively be returned in new condition, in their original packaging in perfect condition and duly sealed. Products damaged, damaged or soiled by the customer are not taken back.

Before any return, the customer must first contact Vegan Mania SARL by chat or by phone +33 (0)1 88 33 65 37 to receive a return number.

The costs relating to the return shipment are the responsibility of the sender, except in the event of lack of conformity of the products delivered with respect to the order. No items sent in COD mode will be accepted by Vegan Mania.

In return for compliance with the above procedure, Vegan Mania SARL undertakes to exchange or refund the products as soon as possible (maximum 14 working days) following receipt of the goods returned. In case of exchange of product(s), the costs related to a new delivery are the responsibility of the customer.

Returns should be made to: Véganie – Service Retours – 55 Boulevard de Sébastopol 75001 Paris – France. All risks related to the return of the products are the responsibility of the customer.

11. RESPONSIBILITY

Vegan Mania SARL cannot be held liable in the event of a technical problem preventing access to the site, unavailability of a product offered on the site, inaccuracy or omission concerning the information contained on the site, of events likely to stop or reduce the manufacture, the transport of the goods or to prevent the normal execution of the sales.
